Welcome to Mount Elegance Treks and Expedition! We are a reputed and credible, officially certified trekking company in Nepal, dedicated to providing exceptional service to our customers. Our primary goal is to ensure your satisfaction by offering safe and memorable travel experiences. Please carefully review the following terms and conditions before booking your trip with us. These terms apply from the moment you make your booking.

1. General Booking Conditions

          For all tours and treks in Nepal, Tibet, and Bhutan, a photocopy of your passport and a deposit of 20% of the total trip cost is required at the time of booking. This deposit is non-refundable and will be considered a cancellation fee if you choose to cancel your trip at any point after booking. The remaining balance can be paid before the trek via credit card or bank transfer, with bank details provided upon request. To avoid a 4% surcharge, it is recommended to pay the balance in cash.

          Note: For tours to Bhutan and Tibet, the remaining balance must be paid 20 days before your departure if you are flying directly to these countries. We reserve the right to cancel your trip if full payment is not received within the specified time.

          2. Mode of Payment

            We accept payments through wire transfer or credit card.

            • Wire Transfer: The provided bank payment details below is an authorized official bank account of Mount Elegance Treks and Expedition Pvt. Ltd. It only belongs to the company and reserves the right to claim the possession with the complete reliability and formality of law as well as by clause disclosed in the opening account.

            Please note that all bank service charges associated with wire transfers are the responsibility of the client.

            • Credit Card: Payments by credit card are quick, easy, and secure, ensuring a seamless transaction experience. We accept all major credit cards, including Visa, MasterCard, American Express, allowing you to make payments conveniently from anywhere. Please note that a processing fee of 4% will be applied to all credit card payments to cover transaction costs. This fee helps us maintain the security and efficiency of our payment system, ensuring that your transactions are processed smoothly and without delay. Rest assured, all payments are encrypted and protected for your security.

            3.  Last-Minute Bookings

            We gladly accept last-minute bookings for trips to Nepal, provided they are made at least 3 days before the departure date. If you wish to secure a last-minute trip, please reach out to us at our official email address info@mountelegancetreks.com or contact us via WhatsApp at +977-9869322210. Our team will do their best to accommodate your request and ensure a smooth booking process. However, please note that last-minute bookings may be subject to availability, and certain arrangements, such as permits or accommodations, may be limited. Additionally, last-minute bookings for tours in Bhutan or Tibet may not always be possible due to travel regulations and permit requirements. We recommend booking in advance to ensure a hassle-free experience.

            4. Cancellation Policy

            a. Company Cancellation 

              In exceptional cases, unforeseen events and circumstances beyond our management and the client’s control may cause trip delays or require rescheduling. We understand that such situations can arise unexpectedly, and we strive to offer flexible alternatives based on your availability.

              If a trip cancellation becomes necessary, we provide a refund of the advance payment under specific conditions. If the cancellation is due to religious, cultural, economic, political, or social factors and the local authorities impose restrictions on travel, clients will have the option to either switch to an alternative trip of equivalent value or postpone their journey to a later date.

              However, Mount Elegance Treks and Expedition Pvt. Ltd. will not be liable for cancellations resulting from such unavoidable circumstances. To safeguard against financial losses, we strongly recommend travelers obtain comprehensive travel insurance.

              Additionally, guidance from our experienced trekkers, Sherpas, and local residents should be carefully considered while traveling, especially regarding weather conditions, trail conditions, and other critical factors. Their expertise and knowledge of the terrain can help ensure a safe and enjoyable trekking experience. Ignoring such advice may lead to unnecessary risks or difficulties during the journey. For the safety and well-being of all participants, the decisions made by our trek leaders will be final and must be followed accordingly.

              b. Trip Cancellation by the Clients

                If the client decides to cancel the trip, the 20% deposit made at the time of booking will serve as the cancellation fee and is non-refundable. If you have made payments beyond this deposit, the balance will be refunded to you, minus the deposit amount. 

                Please be aware that once the trip has commenced, no refunds will be issued to clients who choose to discontinue their journey for any reason.

                5. Trip Amendment Policy 

                Trip amendments may become necessary due to unforeseen circumstances that require adjustments to the planned itinerary. External factors beyond our control, such as adverse weather conditions, landslides, or other natural disruptions, may impact the trip. In such cases, our company will provide timely guidance and alternative solutions to ensure the best possible experience for our clients.

                If a client wishes to modify their trip for personal reasons, a written amendment request must be submitted to the company. The approval and feasibility of such changes will be determined at the company’s discretion based on availability and operational factors.

                Trip Amendment Fees:

                • Amendment requests made 30 days or more before the original departure date: A fee of USD 50.00 per person will be applied.
                • Amendment requests made less than 30 days before the original departure date: Charges will be equivalent to the standard cancellation fees, as payments to hotels, lodges, group operators, and airlines are made in advance.

                We recommend planning any modifications well in advance to avoid additional costs and ensure a smooth adjustment process.

                 6. Risk and Liabilities

                All tours to Nepal, Tibet, and Bhutan are conducted in strict accordance with the rules and regulations set by the respective tourism authorities. Mount Elegance Treks & Expedition Pvt. Ltd. is not responsible for any changes, delays, or cancellations caused by unavoidable circumstances, including but not limited to government restrictions, natural disasters, political instability, flight cancellations, or unforeseen health emergencies.

                In the event of such disruptions, any additional expenses arising from accommodation, transportation, permits, or other logistical changes must be covered by the client. While we strive to minimize inconvenience and assist in finding alternative solutions, certain factors remain beyond our control.

                To safeguard against unexpected losses, we strongly recommend that all travelers obtain comprehensive travel insurance covering trip cancellations, medical emergencies, lost baggage, and other potential risks. By booking a trip with us, clients acknowledge these risks and agree to travel under these conditions.

                7. Health & Fitness Requirements

                Clients must inform in writing about any existing medical conditions at the time of booking. This includes any mental or physical conditions that may impact their ability to participate in the trip. Failure to disclose such conditions may result in the client being denied participation, and in such cases, no refunds will be issued.

                Additionally, we encourage travelers to consider other factors that may affect their mobility during trekking, such as age, pregnancy, or any other health-related concerns. Choosing a trip that aligns with your fitness level is crucial for a safe and enjoyable experience. The company is not obligated to provide special accommodations unless explicitly agreed upon in writing.

                While we always strive to accommodate special requests, including dietary preferences, these do not form a contractual obligation, and the company cannot be held responsible if such requests cannot be fulfilled. Medical facilities and healthcare standards vary across different regions, and we make no guarantees regarding the availability or quality of medical treatment during the trip. We highly recommend that all travelers obtain appropriate medical insurance and consult with a healthcare professional before embarking on their journey.

                8. Travel Insurance

                It is mandatory for all clients to have comprehensive travel insurance that covers medical expenses, personal accidents, emergency evacuations, trip cancellations, theft, and damage or loss of personal belongings. Given the diverse geography and challenging terrains of Nepal, Tibet, and Bhutan, having proper travel insurance is essential for a safe and hassle-free journey.

                Many trekking routes pass through remote and high-altitude regions where medical facilities are limited or unavailable. The risk of altitude sickness, injuries due to rugged trails, unpredictable weather conditions, or even natural disasters like landslides and avalanches cannot be ruled out. In such cases, emergency evacuation via helicopter may be required, which can be extremely costly without insurance coverage.

                Furthermore, different regions present unique challenges—while some trails involve steep ascents and rough paths, others may have icy slopes, river crossings, or high mountain passes that demand physical endurance and caution. Even cultural and sightseeing tours in urban and rural settings come with potential risks such as road accidents, illnesses, or unforeseen circumstances leading to trip disruptions.

                To ensure peace of mind and financial protection, we strongly advise all travelers to obtain a travel insurance policy that adequately covers all possible risks associated with their trip. It is the client’s responsibility to verify that their insurance provider covers high-altitude trekking and emergency medical evacuations specific to their destination.

                9. Flight Delays and Cancellations

                Flights to remote areas in Nepal, particularly in regions like Everest, Annapurna, Dolpo, Simikot, and Jumla, are highly dependent on weather conditions. Due to unpredictable mountain weather, strong winds, heavy rainfall, dense fog, or sudden changes in visibility, flights may be delayed or even canceled. This is especially common in high-altitude airstrips such as Lukla, Jomsom, and Juphal, where small aircraft are used, and safety is the top priority.

                We strongly advise travelers to allocate extra time and budget for unforeseen delays, as they may require additional expenses for food, accommodation, and alternative transportation. It is also recommended to schedule international flights with some buffer days to avoid missing connections due to domestic flight disruptions.

                Mount Elegance Treks & Expedition Pvt. Ltd. is not responsible for any additional costs incurred due to flight delays or cancellations. However, we will assist in making alternative arrangements whenever possible, such as rescheduling flights or exploring overland travel options where feasible. To minimize inconvenience, we also recommend that all travelers have comprehensive travel insurance that covers trip delays, cancellations, and emergency evacuations.

                10. Passport, Visa, and Travel Documents

                All travelers must ensure they have a valid passport, visa, and necessary travel documents before embarking on their journey. Passports should have at least six months of validity beyond the intended travel period to avoid any entry restrictions. It is the responsibility of the client to obtain the appropriate visa and permits required for their destination, whether it be Nepal, Tibet, or Bhutan. Visa policies may vary, with some countries offering on-arrival visas, while others require advance application.

                For trekking in restricted areas, special permits such as TIMS (Trekkers’ Information Management System) cards, national park permits, or restricted area permits may be required, which we can assist in arranging. However, travelers must provide the necessary documents, including passport copies and passport-sized photographs, to facilitate the process.

                Additionally, we advise clients to carry multiple photocopies of their passport, visa, and travel insurance as a precaution in case of loss or emergency. Any issues arising due to incomplete or invalid travel documents will be the sole responsibility of the traveler, and Mount Elegance Treks & Expedition Pvt.Ltd. will not be liable for any travel disruptions, fines, or additional expenses incurred due to documentation errors.

                11. Trip Duration and Refund Policy

                If a booked trip is completed earlier than the scheduled duration outlined in the trip package,Mount Elegance Treks & Expedition Pvt. Ltd will not provide any refunds for the unused days. However, if the trip extends beyond the originally planned duration due to personal preferences, unforeseen circumstances, or additional services requested by the client, any extra costs incurred, such as accommodation, food, transportation, or guide services, must be covered by the client. We recommend careful planning and flexibility to accommodate potential changes during the journey.

                12. Personal Belongings

                While on the trip, our team will make every effort to ensure the safety of your luggage and personal belongings. However, Mount Elegance Treks and Expeditions Pvt. Ltd. cannot be held responsible for any loss, theft, or damage that may occur while your items are being transported by porters, ponies, or vehicles. To safeguard against such risks, we strongly recommend that clients obtain comprehensive travel insurance that covers baggage loss, theft, or damage. We also advise travelers to keep valuables such as passports, money, and electronics in a secure, easily accessible place at all times.

                13. Dispute Resolution

                In the event of a dispute, all legal matters will be handled in accordance with the laws of Nepal. Any disputes arising between the client and the company will be settled in the courts of Kathmandu, Bagmati Province, as per Nepalese legal regulations.

                14. Conduct During Tours

                All travelers are expected to adhere to local laws, customs, and ethical travel practices while on tour. Any form of illegal activity, including but not limited to drug use, theft, violence, or disrespecting cultural norms, is strictly prohibited. If a client engages in any unlawful behavior, Mount Elegance Treks & Expedition Pvt. Ltd will not be responsible for any legal consequences, fines, or additional expenses incurred due to their actions.

                Furthermore, any behavior that endangers the safety, well-being, or enjoyment of fellow travelers, guides, or local communities may result in immediate removal from the trip without any entitlement to a refund. Clients are also expected to follow environmental conservation guidelines, respect wildlife, and practice responsible tourism to preserve the natural and cultural heritage of the destinations visited.

                We strongly encourage all travelers to conduct themselves in a manner that promotes mutual respect, safety, and a positive travel experience for everyone involved. Failure to comply with local regulations and tour guidelines may lead to legal action, fines, deportation, or denial of further services, for which the company holds no responsibility.
